Job Summary:

This position is responsible for the efficient operations and day to day management of the business of the Magistrate Court.

Major Duties:

  • Manages the logistical functioning and flow of courtroom activities to ensure the court runs in an efficient and professional manner.
  • Preside over civil and criminal non-jury trials within the Court’s jurisdiction and render written orders and judgments.
  • Be familiar with and comply with the Georgia Code of Judicial conduct.
  • Attend mandatory training and continuing judicial education.
  • Supervise Magistrate Court Clerk and Administrative personnel.
  • Ensure the proper accounting and distribution of fines and fees paid to the Court.
  • Schedules Court sessions.
  • Approves arrest warrants and search warrants based on probable cause.
  • Conducts first appearance hearings as needed.
  • Appoints other Magistrate Judges (with the consent of the Superior Court Judges).
  • Sets policy for the Magistrate Court.
  • Assigns cases to Magistrate Judges as needed.
  • Reviews criminal history of defendants in connection with setting of setting bail/bond.
  • Delivers motions and orders to various court personnel, litigants, or attorneys.
  • Interacts with other judges, clerks of court, litigants, attorneys, law enforcement and the general public to exchange information and facilitate task completion.
  • Prepares correspondence, memoranda, orders, reports, emails, and other documents observing strict confidentiality.
  • Responsible for the maintenance of departmental reports and records.
  • Prepares the annual departmental budget for submission to the County Commission for approval.
  • Performs other related duties as needed for the efficient operation of the Magistrate Court.

Minimum Qualifications

  • Must have resided in the County for at least one year.
  • Must be 25 years of age.
  • Must have a high school diploma.
  • Possession of a valid Driver's License.
  • Strong oral and written communication and presentation skills.
  • Sufficient experience to understand the basic principles relevant to the major duties of the position, usually associated with the completion of an apprenticeship/internship or having had a similar position for at least two years.

Knowledge Preferred (Preference given to candidate that has this knowledge):

  • Knowledge of Magistrate Court practices, procedures, and legal terminology.
  • Knowledge of differentiated case management techniques.
  • Knowledge of local, state, and federal guidelines and regulations as they pertain to Magistrate Court.
  • Knowledge of the basic structure of the Courts and Criminal Justice system.
