Public Defender Appointments for the City of South Fulton Municipal Court

The City of South Fulton has openings for contract public defenders for Municipal Court.  South Fulton Municipal Court handles indigent traffic offenses, code enforcement violations, and municipal ordinance offenses.  The applicant must be willing and able to handle cases virtually and in person as needed.  Prior experience in criminal defense representation required.

To be considered for this position, candidates must possess a Juris Doctorate from an accredited college or university.  Performs other related duties as required.  Applicant must have 3-5 years of criminal trial experience and be a member in good standing of the State Bar of Georgia.  Interested applicants should submit a resume and a copy of their standard Attorney/Client fee agreement to Ladawn.jones@cityofsouthfultonga.gov  

Description of Duties: The public defender will be assigned based on the calendar and will handle all qualified indigent cases assigned on that calendar. This position performs as a lead attorney. Performs other related duties as assigned.

  • Represents clients in court at various stages of cases, including first appearance, arraignments, preliminary and pretrial hearings, probation and sentencing, or any related courtroom proceedings: negotiates at all stages on behalf of the client; prepares and argues motions; conducts bench trials, makes opening and closing statements, presents evidence, and questions witnesses; and makes appropriate objections and arguments.
  • Reviews discovery; interviews clients in and out of custody; requests and inspects records and evidence; review criminal histories; identifies and interviews witnesses; subpoenas witnesses and prepares them for trial; prepares clients for trial;
  • Receives and reviews various documentation, including police reports, witness statements, laboratory reports, criminal histories, defense motions, and case law updates; reviews, completes, processes, forwards or retains as appropriate; prepares or completes various forms, reports, correspondence, and other documentation, including a variety of motions, orders, letters, notices, petitions, legal briefs, trial summaries, and departmental reports;
  • Communicates with prosecuting attorneys, judges, investigators, legal support staff, witnesses, experts, translators, client friends and family, probation officers, supervisor, government officials, other employees, the public, and other individuals as needed to coordinate work activities, review the status of work, present or exchange information, provide legal counsel and interpretation, or resolve problems.

THIS IS A CONTRACT POSITION PAID PER APPEARANCE.  Payments per appearance will vary based on appearance type. 

1. Plea & Arraignment, Code, other non-trial hearings: $250 per court appearance.

2. Trial Calendar Fee: Additional $100 per case for each case that results in a trial. (That is $250 for the appearance + $100 for each case that goes to trial on the calendar.  This additional fee compensates for any out of court preparation that is necessary for trial.)

3. Appearance fee: $125 for appearances when no cases are assigned to the defense attorney to compensate for them holding their time.
